The development of the legal framework for defence and security procurement in the EU has taken place over the past 20 years. This development has been characterised by harmonisation in an area where, as a general rule, Member States retain full autonomy. It has also involved a number of institutional initiatives by the EU, which have increased cooperation between Member States in areas such as research, development, and procurement. Today, the EU’s framework for defence and security procurement represents a pragmatic compromise: sufficient flexibility for Member States while promoting harmonisation and competition at the European level. The way forward is shaped by global events, which will likely lead to increasingly close cooperation between Member States in defence and security procurement.
